The City of Scottsboro reminds citizens of the fireworks ordinance passed by the Council in April, and the Scottsboro Police Department will be enforcing the ordinance.
Ordinance further regulating the sale or use of fireworks within the city limits of the City of Scottsboro, Alabama and other matters with respect thereto:
Section One: As used in this Ordinance the term “Fireworks” shall have the same definition as described in Section 8-17-217 of the Code of Alabama (1975, as amended) or items classified as Class C Common Fireworks by the U.S. Department of Transportation.
Section Two: It shall be unlawful for any person, firm, corporation or entity to use, ignite or explode any fireworks within the City limits of the City of Scottsboro between the hours of 10:00 p.m. in the evening and 8:00 a.m. in the morning without a permit.
Section Three: Permits may be allowed in accordance with the rules and regulations of the State Fire Marshall and approved by the Fire Chief and Police Chief of the City of Scottsboro.
Section Four: It shall be unlawful to sell, offer to sale, keep or have in possession, barter, exchange, or give away, furnish or otherwise use, dispose any pyrotechnics other than those permitted by the Alabama State Fire Marshall.
Section Five: No city license shall be issued for the sale of permitted fireworks under the laws of the State unless the applicant shall first obtain a permit from the State Fire Marshall showing compliance with all State laws and a letter from the City’s License Inspector stating the location from which such fireworks are sold meets all City zoning requirements.
Section Six: It shall be unlawful for there to be any use of non State Fire Marshall permitted fireworks when a no burn order has been issued by the State Fire Marshall or any other legal no burn order is in effect.
Section Seven: Any person being found guilty of a violation of any section of this ordinance shall be guilty of a misdemeanor and their business license may be suspended or revoked by the Court for violations of Sections 4 and 5.
