An Order has been issued in reference to a Motion to Dismiss filed by The City of Scottsboro in Manning v. City of Scottsboro.
The lawsuit, filed in December 2023 by former Scottsboro police officer Ryan Manning alleges in part that Manning was maliciously prosecuted for allegedly harming his infant daughter.
Manning was found not guilty in June 2023 of those allegations, investigated by the Alabama Law Enforcement Agency and the State Bureau of Investigation.
Manning named the City of Scottsboro, the Scottsboro Police Department, Chief Ron Latimer, Officer Taylor Miller, Officer Wesley Taymon and Officer Tyler McLemore in the suit.
Manning alleged that the Chief and the officers, under the supervision of the City of Scottsboro and the Scottsboro Police Department, maliciously caused the prosecution and criminal proceedings against him, by directing SBI to characterize him as a child abuse suspect.
The Motion to Dismiss was filed in February 2024.
Jackson County Circuit Judge Brent Benson issued a thirteen-page Order regarding the motion. The Order dismissed, with prejudice, the claims against the Scottsboro Police Department, Chief Ron Latimer, Officer Tyler McLemore, Officer Taylor Miller and Officer Wesley Taymon.
Counts in Manning’s lawsuit, claiming Malicious Prosecution, Abuse of Process, False Imprisonment, Negligence, Slander per se, Libel to Plaintiff’s In-Law’s, Libel during Criminal Trial, Intentional Infliction of Emotional Distress, Wantonness, Outrage, Invasion of Privacy were also dismissed with prejudice.
However, the allegations regarding negligent hiring, training and supervision may proceed against the City of Scottsboro.
