Court of Civil Appeals affirms Adams conviction

A memorandum regarding the appeal filed by David Wayne Adams has been filed by the Alabama Court of Civil Appeals.
Adams was found guilty by a jury in August 2023 on four counts of Sexual Abuse of a Child under 12; three counts of Rape 2nd degree; three counts of Sodomy 2nd degree; two counts of Enticing a Child for Immoral Purposes; and one count of Production of Obscene Matter with a Child under 17. The Jury found Adams not guilty on two additional counts of Sexual Abuse 2nd degree. Adams was sentenced in November 2023.

The memorandum states, “The circuit court sentenced Adams as a habitual felony offender to life imprisonment for the following convictions: Sexual abuse of a child less than 12, rape in the second degree, sodomy in the second degree and production of obscene matter containing visual depiction of a person under 17 years of age involved of obscene acts. The circuit court sentenced Adams to 99 years imprisonment for his convictions for enticing a child for immoral purposes and to 12 months in jail for his conviction for sexual abuse in the second degree. The circuit court ordered all the sentenced to run consecutively. The court further ordered Adams to pay the maximum fine and assessments under Alabama law in each conviction and ordered post release supervision in the production of obscene materials convictions. 

Adams filed a letter brief on August 31, 2024, listing several points for our review. Adams alleged, that out of court statements made by the victims were inadmissible hearsay; that the indictments against him were based on excessive hearsay; that the indictments did not state any dates or times and prejudiced him in preparation of his defense; that the circuit court erred by allowing photos of the victims into evidence; that one of the victims did not testify and corroborate testimony given by other victims; and that the court erred by allowing the victims to remain in the courtroom during trial. Adams alleged numerous claims of ineffective assistance of counsel as well as several claims that the State withheld evidence in violation of Brady v. Maryland.

In addition to the issues raised by Adams, we have reviewed the record in this case and have found no error warranting reversal. Based on the foregoing the circuit court’s judgement is affirmed.”
